Terms of Service

These Terms of Service (“Terms”) govern your use of the LEWCA plugin and the lewca.com website, operated by Merkra (“we,” “us,” or “our”). By installing the LEWCA plugin or using our website, you agree to these Terms.

1. Description of Service

LEWCA is a WordPress accessibility plugin that provides an accessibility toolbar, WCAG scanning, automated fixes, and related tools. LEWCA is offered in two tiers:

• Free: 32-button accessibility toolbar (font controls, contrast modes, color blind filters, navigation aids), 38 WCAG checks, 21 automated frontend fixes, manual fix editor, bulk fix walkthrough, legal document generator, dashboard widget, and scan history with CSV export. No payment or account required.
• Pro: All free features plus 19 additional toolbar buttons (8 disability profiles, Read Aloud TTS, translate, dictionary, reading mask, text magnifier, and more), 7 deep scan checks, AI-powered fix system for 43 issue categories, scheduled scanning, email notifications, PDF/DOCX report export, toolbar customization persistence, theme color auto-detection, issue dismissal, and runtime fix engine. Requires an active paid license.

2. Plan Tiers and Pricing

LEWCA Pro is available in the following plan tiers:

• Pro Annual 1-Site: $249/year — 1 site, billed annually
• Pro Annual 3-Sites: $599/year — 3 sites, billed annually
• Pro Annual 10-Sites: $1,499/year — 10 sites, billed annually
• Pro Annual 25-Sites: $2,999/year — 25 sites, billed annually, includes white-label rights
• Lifetime 1-Site: $599 one-time — 1 site, permanent license
• Lifetime 3-Sites: $1,437 one-time — 3 sites, permanent license
• Lifetime 10-Sites: $3,590 one-time — 10 sites, permanent license
• Lifetime 25-Sites: $7,225 one-time — 25 sites, permanent license, includes white-label rights

Pricing is determined by tier based on total active sites across all billing types. Volume discounts apply as follows: Personal (1-2 sites), Business (3-9 sites), Agency (10-24 sites), Enterprise (25-50 sites). When a site addition crosses a tier boundary, any overpayment relative to the new tier rate is credited to your Stripe account balance. Self-serve licensing supports up to 50 sites. For more than 50 sites, contact us for enterprise pricing.

The 25-Sites plans (yearly and lifetime) include white-label rights, allowing licensees to remove LEWCA branding from the toolbar on all licensed domains. Current pricing is always listed at lewca.com/pricing.

3. License and Usage Rights

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to install and use LEWCA on the number of WordPress sites covered by your license tier. Free users may install LEWCA on unlimited sites. Pro licenses are issued per-site or per multi-site bundle as specified at the time of purchase.

You may not:

• Redistribute, resell, or sublicense the Pro version of LEWCA without written authorization
• Reverse engineer, decompile, or attempt to extract the source code of server-side Pro features
• Use LEWCA for any unlawful purpose or in violation of any applicable laws
• Remove, alter, or obscure any proprietary notices or labels in the plugin (except under white-label rights included with the 25-Sites plan)

4. Domain Management

4.1 Master Domain

Every Pro license has a master domain, which is the domain provided at the time of purchase. Only the WordPress admin panel on the master domain can manage all sites associated with the license, including adding, removing, and viewing licensed domains. The master domain cannot be removed from a license under any circumstances.

4.2 Adding and Removing Domains

Licensees may add domains to their license at any time, up to the site limit included in their plan tier. All domains are normalized before storage: protocols are stripped, the “www” prefix is removed, and the domain is converted to lowercase. For example, “https://www.Example.com” is stored as “example.com.”

4.3 Additional Site Add-Ons

If you have reached the site limit included in your plan, additional sites may be purchased as add-ons. Add-on pricing is based on your current tier (determined by total active sites across all billing types):

• Business tier (3-9 sites): $199/yr or $479 lifetime per additional site
• Agency tier (10-24 sites): $149/yr or $359 lifetime per additional site
• Enterprise tier (25-50 sites): $119/yr or $289 lifetime per additional site

Yearly add-on pricing is prorated based on the number of full months remaining in the current subscription period. A minimum charge of $10 applies to all yearly add-on purchases. Yearly add-on purchases are processed as one-time payments — they do not modify the underlying subscription and do not automatically renew. Lifetime add-on purchases are one-time payments and are permanently locked to the assigned domain.

You may choose yearly or lifetime billing for each add-on site independently. A single license may contain a mix of yearly and lifetime sites (see Section 6).

The Pro Annual 1-Site and Lifetime 1-Site plans do not support add-on site purchases at the Personal tier rate. Adding a site to a 1-site plan upgrades the license to the Business tier.

5. Grace Period and Domain Lock

5.1 Initial Grace Period

Upon initial purchase of any annual plan, a 7-day grace period begins. During this window, you may freely add or remove domains associated with the license, with the exception of the master domain.

5.2 Domain Lock

After the 7-day grace period expires, all domains on the license are locked for the remainder of the subscription year. During the locked period:

• Domains cannot be removed from the license.
• New domains can still be added up to the plan’s site limit, or through add-on purchases.

5.3 Renewal Grace Period

When a subscription renews, a new 7-day grace period opens. During this window, you may remove domains you no longer wish to license, add new domains up to the site limit of your selected plan tier, and rearrange your domain portfolio as needed. After the 7-day renewal window closes, domains are locked again for the remainder of the new subscription year.

6. Lifetime Plans

Lifetime licenses grant perpetual access to LEWCA Pro features for the licensed domain(s). Lifetime plans are available for 1, 3, 10, or 25 sites. Lifetime licenses are subject to the following terms:

• Each lifetime domain slot is permanently locked to the assigned domain after the 30-day refund window.
• No domain changes are permitted on lifetime slots after the refund period, under any circumstances.
• Priority support is included for 2 years from the date of purchase. After 2 years, lifetime licensees receive community support.
• All future Pro features are included for the lifetime of the product.
• The sole remedy for domain selection errors is the 30-day money-back guarantee described in Section 9.

6.1 Mixed Licenses

A single license may contain both yearly and lifetime domain slots. This is referred to as a “mixed” license. Mixed licenses operate under the following rules:

• Each domain is independently tracked as either yearly or lifetime billing.
• Yearly domains follow the grace period and domain lock rules in Section 5.
• Lifetime domains are permanently locked to their assigned domain.
• Tier pricing is determined by the total number of active sites across both billing types.
• All domains on a mixed license share the same Pro feature set regardless of billing type.

7. Free Trial

We offer a 7-day free trial of Pro features. No credit card is required to start a trial. Each WordPress domain is eligible for one trial. After the trial period, Pro features will be disabled unless you purchase a license. Your site’s content and free features are not affected when a trial expires.

8. Payment, Billing, and Renewal

• Pro licenses are billed annually unless purchased as a lifetime plan.
• Payments are processed by Stripe. We do not store your credit card information.
• Annual licenses renew automatically unless cancelled before the renewal date.
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
• At renewal, you may upgrade, downgrade, or remain on the same plan tier.

9. Refund Policy

All LEWCA Pro plans include a 30-day money-back guarantee from the date of purchase. Two refund options are available:

• Full refund: The license is suspended immediately upon processing. All associated domains lose access to Pro features.
• Partial refund: The license remains active for the duration of the current subscription period. Pro features continue to function on all licensed domains.

Lifetime add-on sites are refundable within 30 days of the add-on purchase date. After 30 days, lifetime site slots are permanent and non-refundable. Each add-on purchase has its own 30-day refund window independent of the original license purchase date.

10. Accessibility Disclaimer

LEWCA helps identify and remediate many common accessibility issues, but no automated tool can guarantee legal outcomes or standards conformance on its own. Manual review and ongoing accessibility practices remain important. LEWCA is a tool to assist with accessibility — it is not a substitute for professional accessibility auditing, legal advice, or compliance certification.

11. Intellectual Property

LEWCA, including its code, design, documentation, and branding, is owned by Merkra and is protected by applicable intellectual property laws. The free version of LEWCA is licensed under the GNU General Public License v2 (GPLv2) as required for WordPress.org distribution. Pro features are proprietary and subject to these Terms.

12. User Content and Data

You retain ownership of all content on your WordPress site. LEWCA processes your content locally for scanning and analysis purposes. For AI fix features (Pro), small code snippets are transmitted to our servers for processing as described in our Privacy Policy. We do not claim any ownership over your content.

13. Service Availability

We strive to maintain reliable service but do not guarantee uninterrupted availability of lewca.com, license validation, or AI fix processing. The free version’s core functionality (toolbar, scanning, automated fixes) operates entirely within your WordPress installation and does not depend on our servers being available.

14. Disclaimer of Warranties

LEWCA is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that LEWCA will meet your specific requirements, that results will be accurate or reliable, or that the service will be uninterrupted or error-free.

15. Limitation of Liability

To the maximum extent permitted by applicable law, Merkra shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of LEWCA. Our total liability for any claim arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

16. Termination

We may suspend or terminate your access to Pro features if you violate these Terms. You may stop using LEWCA at any time by deactivating and uninstalling the plugin. Upon uninstallation, LEWCA removes its settings and data from your WordPress database (scan results, scores, and configuration) if you enable “Delete data on uninstall” in settings.

17. Governing Law

These Terms are governed by the laws of the State of Washington, United States, without regard to conflict of law principles.

18. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated effective date. Continued use of LEWCA after changes constitutes acceptance of the revised Terms.

19. Referral Program

LEWCA offers a referral program that allows Pro and Lifetime license holders to earn commissions by referring new customers.

19.1 Commission Structure

Referral commissions are calculated at 30% of the single-site base price for the purchased plan type. For Pro Annual plans, the commissionable amount is $249 (the 1-site base price) regardless of the number of sites purchased. For Lifetime plans, the commissionable amount is $599 (the 1-site base price) regardless of the number of sites purchased. Multi-site add-on purchases, tier upgrades, and subscription renewals do not earn additional commissions.

19.2 Commission Payments

All commissions are held for a 30-day period following the qualifying purchase (the money-back guarantee period). After the hold period, approved commissions are released for payout via Stripe Connect. Referrers must complete Stripe onboarding to receive payouts. If a customer requests a refund during the 30-day hold period, the associated commission is reversed.

19.3 Prohibited Practices

Self-referrals are prohibited. You may not use your own referral link to purchase licenses for yourself or for domains you own or operate. We employ automated fraud detection to identify self-referrals and repeated referrals from the same customer. Violations may result in commission forfeiture and removal from the referral program. Merkra reserves the right to review, approve, or reject any commission at its sole discretion.
